Frequently Asked Questions

What is the Streamlined Package?

This package helps U.S. taxpayers correct past non-compliance with foreign account and income reporting requirements through the IRS Streamlined Filing Compliance Procedures. If your non-compliance was non-willful (due to misunderstanding, oversight, or error), this program provides a way to come into compliance with significantly reduced penalties compared to traditional enforcement.

As part of the Streamlined Filing process, we’ll prepare your amended or original tax returns, FBARs, and non-willfulness certification. We electronically file the FBARs for you, and provide the rest of the documents in a complete, ready-to-mail package — along with clear instructions so you can send it directly to the IRS.

You may qualify if you:
  • Are a U.S. citizen or green card holder
  • Have unreported foreign financial accounts or foreign income
  • Missed filing required forms such as FBARs, Form 8938, or other international forms such as Form 5471, Form 8621, Form 3520, and/or Form 3520-A, etc.Missed filing required forms such as FBARs, Form 8938, or other international forms such as Form 5471, Form 8621, Form 3520, and/or Form 3520-A, etc.
  • Are not currently under IRS audit or criminal investigation
  • Can certify your non-compliance was non-willful
We assist both:
  • U.S. residents through the Streamlined Domestic Offshore Procedures
  • U.S. taxpayers abroad through the Streamlined Foreign Offshore Procedures

We provide complete support with:

  • Preparation of 3 years of original or amended tax returns (Form 1040 or Form 1040-X)
  • Filing of up to 6 years of delinquent FBARs (FinCEN Form 114)
  • Assistance with Form 14653 or 14654 (non-willfulness certification)
  • Calculation of the 5% offshore penalty for domestic streamlined filers, if applicable
  • Clear mailing instructions or submission assistance

Streamlined Domestic (for U.S. residents):

  • Subject to a 5% penalty on the highest year-end balance of unreported foreign financial assets
  • Requires filing Form 14654

Streamlined Foreign (for U.S. taxpayers abroad):

  • No 5% penalty if you meet the IRS non-residency criteria (e.g., outside the U.S. for 330+ days in one year of the last three)
  • Requires filing Form 14653

We help determine which program applies to you and ensure all required documents are correctly prepared.

Your statement of facts explains why you failed to report your foreign income or accounts, and it’s a critical part of the streamlined submission. It should include:

  • Why you didn’t file or report (e.g., confusion, incorrect advice)
  • Personal and financial background
  • Where the accounts came from (e.g., inheritance, opened abroad)
  • How the accounts were used (e.g., deposits, withdrawals, investments)
  • Any tax professionals you relied on, and what they advised
  • Separate explanations for each spouse, if filing jointly with different circumstances

We assist you in reviewing and organizing the information required, and we guide you through what to include based on your responses and documents.

We’ll also guide you on what the IRS expects to see in your narrative statement and help you understand what details to include based on your situation. That said, your statement is based entirely on the information you share with us, and it’s your responsibility to make sure everything is accurate and complete. The IRS makes the final decision on whether your submission is accepted.
